Diabetic Indiana Man Receives $400,000 for False Arrest
Michael Overton was arrested, with the assistance of dogs and a taser, after his vehicle sideswiped another car and hit a curb. Deputy Bradley Beaton of Marion County Sheriff’s Department stopped Overton, who became uncooperative. Even after a paramedic treated Overton for low blood sugar, he was arrested and charged with resisting arrest and fleeing the scene of an accident. Due to the fact that Overton’s diabetic condition caused the accident, the charges were eventually dropped.
In their finding, the jury sided with Deputy Beaton in that he did not use excessive force or cause Overton to be maliciously prosecuted. However, because Overton’s diabetic illness became known prior to his arrest, the jury awarded him $300,000 in compensatory and $100,000 in punitive damages. See: Overton v.
